Perhaps you need to back up a bit and think about what your real goals are.  I think your main concern is to help your daughter get the help she needs to pass her FCAT tests. I have a few suggestions towards achieving these goals that have nothing to do with legal rights and definitions.

My first suggestion is to look into Brain Gym(R). It is a technique that using simple exercises to create new pathways in the brain.  You can check out the Brain Gym Foundations web site at www.braingym.org for more information about the techniques and results. If you want to be very proactive and self-directed, the book, "Brain Gym for Business" by Dennison,Dennison & Teplitz is a good starting point for the layperson to use.  In spite of the title, it is applicable to all types of challenges having to do with focus, concentration, understanding directions, reading, auditory processing(and much more).  It is well-organized and has very understandable line drawings and text.

My second suggestion is to use EFT (Emotional Freedom technique.) This technique, though seemingly bizaar to first-time users, actually works. It is based on tapping of meridian points as determined by accupunture. You can go to www.emofree.com to download your free manual. It is a very reputable site and very worthwhile.  Please follow Gary's advice when proceeding through the material.
Both of these techniques will help your daughter get through some of her challenges and if you need more assistance, they will provide further help with referrals.

Good luck.

APD is not recognized as a disability
2005-06-21 23:04

I have a 16 y/o daughter that was diagnosed with APD since age 6.  Started speech therapy at age 3.  When she was in 8th grade her school stated that she passed all her speech and language tests therefore she could no longer be helped by the school system because APD is not a recognized disorder by the State of Florida.  I even have a report from the school district, given by their audiologist stating that she has APD, but they cannot help her with her schooling needs.  But gave suggestion for the teachers, but they don't have to comply because she doesn't have an IEP.          In Florida all 10th grade students must pass two FCAT tests (Math and Writing) which are mandatory for graduation.  She failed both.  Next year she must pass the FCAT Science test.
I've tried and failed at getting her back into ESE and Section 504.
Has anyone found anything in any statute/law that shows APD is a recognized disability?
I have tried to find if ADA and IDEA recongnizes APD and I am unable to locate this...have you?
Has anyone contacted an attorney regarding ADA vs APD?
I would greatly appreciate everyone to give any advise they have.
I have been dealing with trying to get all rights that my deserves for her disability for 10 years and I've beaten my head against the wall so much that I have a concaved forehead.
Thanks!!
